1. Acceptance of Terms
These Terms and Conditions ("Terms") form a binding agreement between you ("User", "you") and Parthiv Vanani ("CureWise+", "we", "us", "our") governing your access to and use of the CureWise+ mobile application and related services (the "Service"). By creating an account, tapping "I Agree," or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree to these Terms, do not create an account or use the Service.
2. Eligibility
- You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. If you are between 13 and the age of majority, you may use the Service only with the involvement and consent of a parent or legal guardian, where permitted by local law.
- You represent that all information you provide during registration is accurate and that you will keep it up to date.
- You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3. MEDICAL DISCLAIMER — PLEASE READ CAREFULLY
CureWise+ IS NOT A MEDICAL DEVICE, HEALTHCARE PROVIDER, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
The Service uses artificial intelligence to provide general information, medicine identification, and possible-condition suggestions based on images and text you provide. By using the Service, you acknowledge and agree that:
- AI-generated content may be inaccurate, incomplete, or outdated, and is provided for general informational and triage purposes only.
- The Service does NOT diagnose any disease or condition, and does NOT provide a definitive or clinically validated result, regardless of how the output is phrased (including any "likelihood," "possible condition," or similar labels).
- You must always independently verify any medicine information before taking any medication, and consult a licensed pharmacist or physician with questions about dosage, interactions, or suitability.
- You should always seek the advice of a physician or other qualified healthcare provider with any questions regarding a medical condition, symptom, medicine, or treatment, and before starting, stopping, or changing any medication or treatment.
- If you believe you may be experiencing a medical emergency, call your local emergency number or go to the nearest emergency room immediately. Do not rely on the Service in an emergency.
- We do not guarantee any specific level of accuracy for AI-generated outputs, and no percentage, score, or confidence level shown in the Service constitutes a clinical or diagnostic guarantee.
YOUR USE OF ANY INFORMATION PROVIDED BY THE SERVICE IS SOLELY AT YOUR OWN RISK.
4. Description of Service
CureWise+ provides the following features, each subject to the Medical Disclaimer above:
- Medicine identification from photographs of packaging/labels.
- General symptom information based on user-described symptoms.
- General information based on user-uploaded health reports (e.g., lab results).
- Optional AI-assisted visual triage suggestions based on photographs of visible symptoms.
We may add, modify, suspend, or discontinue any feature of the Service at any time without liability to you, though we will try to give reasonable notice of material changes where practical.
5. User Responsibilities and Acceptable Use
You agree that you will NOT:
- Use the Service to self-diagnose or self-treat in place of professional medical care, or delay seeking medical care because of Service output.
- Upload images or data that are not your own, or that you do not have the right/consent to upload (e.g., another person's medical records without authorization).
- Use the Service for any unlawful purpose, or to harass, abuse, or harm another person.
- Attempt to reverse-engineer, scrape, or interfere with the Service or its underlying AI systems.
- Misrepresent your identity or age, or create an account on behalf of another person without authorization.
- Upload content that infringes any third party's intellectual property or privacy rights.
6. AI-Generated Content
- The Service uses third-party AI providers to process your submissions. Outputs are generated automatically and are not reviewed by a medical professional before being shown to you unless explicitly stated otherwise in-app.
- We do not warrant that AI outputs will be accurate, complete, reliable, or suitable for any particular purpose.
- You retain ownership of content you upload. You grant us a limited, non-exclusive, worldwide license to process that content solely to provide and improve the Service, subject to our Privacy Policy.
7. Subscriptions & Payments

8. Intellectual Property
All rights, title, and interest in the Service, including its software, design, trademarks, and content (excluding user-uploaded content), are owned by Parthiv Vanani or its licensors. Unauthorized copying or modification of the Application, any part of it, or our trademarks is strictly prohibited.
- You may not extract or attempt to extract the source code of the Application.
- You may not translate the Application into other languages, or create derivative or modified versions, without our prior written consent.
- You may not copy, distribute, sell, or lease any part of the Service without our prior written consent.
9. Third-Party Services
The Service integrates third-party AI processing providers, advertising, analytics, and crash-reporting SDKs (currently Google AdMob, Google Analytics for Firebase, and Firebase Crashlytics), and may link to third-party services (e.g., pharmacy locators, telemedicine partners). Each operates under its own terms and privacy policy. We are not responsible for the content, accuracy, or practices of third-party services, and your use of them is subject to their own terms.
10. Device, Connectivity & Device Security
Because the Service processes health-related images and data, keeping your device secure matters more than for a typical app. Accordingly:
- We strongly advise against jailbreaking or rooting your device. Doing so removes manufacturer security restrictions and may expose your device — and the health data stored or processed on it — to malware, unauthorized access, or data theft. The Service may not function correctly, or at all, on a jailbroken/rooted device, and we are not responsible for any resulting loss.
- You are responsible for maintaining your device's security, including keeping your operating system updated and your account credentials confidential.
- Some features require an active internet connection (Wi-Fi or mobile data). We are not responsible if the Service does not function due to lack of connectivity, insufficient data allowance, or a low/dead battery.
- Standard data charges from your mobile network provider apply when using the Service outside Wi-Fi, including roaming charges if used outside your home country/region with roaming enabled. You are responsible for these charges. If you are not the bill payer for your device, we assume you have obtained the bill payer's permission.
- While we strive to keep the Service accurate and up to date, some information (e.g., medicine data) relies on third parties; we accept no liability for loss arising solely from reliance on that third-party-sourced information being outdated or inaccurate, without prejudice to the Medical Disclaimer in Section 3, which remains your primary safeguard.
11. Updates & Discontinuation of Service
- We may update the Service periodically. Continuing to use the Service requires accepting updates when offered; we do not guarantee ongoing compatibility with every device or operating system version.
- We may discontinue or terminate the Service at any time. Unless we state otherwise, upon termination: (a) your rights and licenses under these Terms end, and (b) you must stop using the Service and, where applicable, delete it from your device.
12. Disclaimers of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PARTHIV VANANI, ITS OFFICERS, EMPLOYEES, AND AI PROCESSING PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF HEALTH, LIFE, DATA, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF (OR RELIANCE ON) THE SERVICE, INCLUDING ANY AI-GENERATED OUTPUT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) [A NOMINAL AMOUNT TO BE SET WITH COUNSEL, E.G., INR 5,000 / USD 100].
Some jurisdictions do not allow the exclusion or limitation of certain damages/warranties — this clause must be adapted per-jurisdiction by counsel, particularly for EU/UK consumer-protection law, which limits how far liability can be disclaimed for personal injury or gross negligence.
14. Indemnification
You agree to indemnify and hold harmless Parthiv Vanani, its officers, employees, and partners from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Service, or violation of any law or third-party right.
15. Account Suspension & Termination
- We may suspend or terminate your account if you violate these Terms, misuse the Service, or if required by law.
- You may delete your account at any time through in-app settings or by contacting us; see our Privacy Policy for data-deletion timelines.
- Sections that by their nature should survive termination (e.g., Medical Disclaimer, Limitation of Liability, Indemnification, Governing Law) will survive.
16. Changes to the Service and These Terms
We may modify these Terms from time to time. We will notify you of material changes via in-app notice or email at least [X days] before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the Service and may delete your account.
17. Governing Law and Dispute Resolution

Nothing in the Service is intended to constitute a regulated medical device unless explicitly certified as such; where local law (e.g., EU MDR, US FDA SaMD guidance, India CDSCO rules) treats health-information software as a regulated device based on its function, we will update the Service's classification, features, or availability in that jurisdiction accordingly.
19. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service.
